JOHN HUGHES COOPER: One of the basic tenants of admiralty and maritime law is that seamen are wards of the admiralty courts. What this means is that federal courts will take particular care to protect the rights of injured seamen.

If seamen are injured subject to the call of duty, they have potentially five claims. Those claims would be for maintenance, for cure or medical care, unearned wages through the end of the voyage, Jones Act claim for negligence. And finally, if their injury is caused by an un-seaworthy condition on the vessel, they would have an un-seaworthiness claim.
