The Longshore and Harbor Workers' Compensation Act offers medical care and compensation for on-the-job injuries that occur either on the navigable waters of the United States or in adjoining areas used in loading, unloading, or repairing a vessel. Stevedores, dockers, longshoremen and other harbor workers, including, ship repairmen are covered by the Longshore and Harbor Workers' Compensation Act.

Medical and Disability Compensation

Medical benefits include all hospital, medical and surgical care; medical supplies and other services required for treatment of the work-related injury; plus compensation for the cost of travel required for such treatment.

Disability compensation is payable for disabilities that are total, partial, permanent or temporary. Disability is defined by the law as "the inability to earn the same wages earned at the time of the injury."

Third Party Claims

Under certain circumstances, the Longshore and Harbor Worker Workers' Compensation Act allows a worker to recover additional damages from parties other than his or her employer. An injured worker may also have a landside product liability claim — against the manufacturer of a forklift or crane that malfunctioned, for example.
